Claim compensation for the violation of your right to honour

If a bank or lender added you to a debtor register such as ASNEF or Badexcel without meeting the legal requirements, as well as demanding removal you can claim compensation (Organic Law 1/1982). Spain's Supreme Court has ruled that this compensation cannot be symbolic.

  1. Identify the error

    Check which company listed you, for what amount and since when. The listing is wrongful if the debt doesn't exist, was already paid, was disputed, was over five years old or you weren't asked to pay first.

  2. Gather evidence

    Contract, account or card number, payment receipts, previous complaints and any credit refusal caused by the listing.

  3. Claim from the lender and the register

    Request in writing the removal of your data and correction of the error. They have one month to reply; if they don't, you can go to the AEPD for free.

  4. File the lawsuit

    With a lawyer and court representative, the lender is sued in the civil courts. You have four years from being removed from the register.
