Right to honour: wrongful listing in ASNEF or Badexcel

If you were added to a debtor register without the legal requirements being met (a debt that doesn't exist, was already paid, is disputed, or without a prior demand for payment), you have the right to demand immediate removal and to claim compensation for the violation of your right to honour (Organic Law 1/1982). Spain's Supreme Court has ruled that this compensation cannot be symbolic, and you have four years to claim from the date you are removed from the register.

Abusive banking practices

If a bank or lender charged you usurious interest (as with many revolving credit cards), non-transparent clauses or undue fees, you have the right to have them declared void and to recover what you overpaid. In usury cases you only have to repay the capital borrowed, and the right to claim nullity never expires.
